In compliance with the provisions of the Federal Law for the Protection of Personal Information in Possession of Individuals (hereinafter the “Law”), through this Privacy Notice (hereinafter the “Notice”), we inform you the following:
GRUPO INDUSTRIAL Y COMERCIAL NAVARRO, S.A. DE C.V. (hereinafter “Quesos Navarro”), who has its domicile in Porfirio Díaz 180 Col. Centro, Tepatitlán de Morelos, Jalisco, C.P. 47600, is responsible for the handling (as defined in article 3 section XVII of the “Law”) of the personal information, including sensitive, financial and property information (hereinafter the “Information”) that is provided by individuals, that is to say, clients, suppliers, employees and/or any individual that provides information (hereinafter the “Holder”) and this has no personal use.
The “Information” can be gathered in person or through our website www.quesosnavarro.com and/or by any other way allowed by the “Law”.
The use of the “Information” shall be limited to:
(i) The application for employment through any means and, if appropriate, the obtention of said employment; (ii) Any procedure that must be carried out before the Mexican Institute of Social Security, (IMSS), the Institute of the National Housing Fund of Employees (INFONAVIT), Tax Administration Service (SAT), the National Fund for Employee´s Consumption (FONACOT) and/or any other government agency; (iii) Granting of credits and/or loans; (iv) Promotions of newly created products; (v) Delivery and/or receipt of products; (vi) Participation in offers and/or promotions; (vii) Invitations to educational, sporting, social, cultural or any other similar events; (viii) Customer service; (ix) Advertising through any means of communication; (x) Market research; (xi) Conclusion of contractual relationships or agreements in accordance to the laws in force in Mexico; (xii) Recording of information in employee books and/or corporate books in accordance to the Federal Labor Law and the General Law of Companies, respectively; (xiii) Any similar purpose.
In the event that "Quesos Navarro" intends to use the information for a different purpose than the one indicated in the "Notice" that is not consistent or similar to those previously described, the “Holder" shall be informed and/or if necessary his/her consent shall be requested for the execution of the new purpose, informing him/her the date on which the change(s) shall become effective, using any of the following means:
(i) Personally, through a written document; (ii) Through our website www.quesosnavarro.com; (iii) Any other way allowed by law.
The "Information" that "Quesos Navarro" has or that it collects at this moment or later are and shall be duly kept, stored and protected by the Personal Data Protection Department of "Quesos Navarro" (hereinafter the "Department"). During the time of the handling, only the members of Quesos Navarro and other employees duly authorized through a confidentiality statement shall have access to it, jointly they will have at their disposal physical and technological tools to prevent their loss, misuse, alteration, disclosure, and theft.
With the signature of the "Notice" you accept and grant your express consent for the transfer of the information, including but not limited, to affiliates and/or subsidiaries, and national or foreign third parties that are individuals or companies that maintain a contractual legal relationships with "Quesos Navarro", it is noted that no consent shall be required to carry out the necessary transfer(s) when any of the cases of article 37 of the "Law" occur.
The “Holder" of the information by his own right or through his/her representative as of January 6, 2012 may request Access, Rectification, Cancellation or Opposition (hereinafter "ARCO Rights") of the "Information", by any of the following means:
(i) Through a written request addressed to the "Department" of "Quesos Navarro", at the following address: Porfirio Díaz 180 Col. Centro, Tepatitlán de Morelos, Jalisco, C.P. 47600 from 9:00 a.m. to 6:00 p.m., on working days; (ii) Through a written request sent to the following e-mail address protecciondedatos@quesosnavarro.com, from 9:00 a.m. to 6:00 p.m. on working days.
Applications must meet the requirements of Article 29 of the "Law", i.e. (i) The name and address of the holder and other means of communicating the response to his request; (ii) Documents proving the identity or, where appropriate, legal representation of the holder; (iii) The clear and precise description of the “Information” over which the exercise of any of the aforementioned rights is requested; and (iv) Any other item or document that eases the finding of the "Information". After the necessary procedure, the person in charge through the "Department" shall communicate to the "Holder" the decision made within the terms established by article 32 of the Law.
In the event that the “Holder" does not receive a response within the term established in the preceding paragraph and/or does not agree with the decision that has been provided, or considers that there was some breach of its "ARCO Rights" in accordance to the terms of the "Law" he may file a complaint or claim before the Federal Institute for Access to Information and Data Protection (IFAI)
